Impacts of LGPD on daily life

Data is the “new oil” and we can confirm this statement. If we think about our daily lives, there are few tasks that we do without using any technology. And to use technology is to include our data for all types of services that we need. When we order food online or access our bank account, our data is there. Even when we do a simple web search, we are already exposed. For this reason, it is good to repeat: data is the “new oil”. Our data is worth a lot! So, it is good to understand the impacts of General Data Protection Law (“LGPD” –  Lei Geral de Proteção de Dados – in Brazil) on our lives. 

What is it?

Law 13.709/2018 aims to regulate Brazilian citizens’ personal data processing, inside and outside Brazil. It is inspired by European law, known as “GDPR” – General Data Protection Regulation – and took effect in Brazil in August 2020.

But what does the law change in my life?

Now, the holder will be able to provide his data when and how he wants. Companies will only be able to use your data with your authorization. All companies which deal with personal data need to ask for your consent, to use them correctly and, for that, they have some basic rules, which the law brings to the holder to feel more secure, everytime he accesses the internet or signs up for an event, for example.

Transparency: If I could summarize the law in one word, it would be this: transparency. The purpose for data collection must be explicit, how they will be treated and how they can be changed and/or removed.

Security: It concerns the protection of data stored in secure systems, to prevent fraud, for example. The holder has the right to the security of his data, so that they can be used with the agreed purpose. Your data, your rules!

Purpose of data collection: Is there a reason for collecting such data? Or for storing many cookies? It is recommended that every page on the web has its Privacy Policy and the use of updated cookies. Search for sites with this information.

What happens if none of this is done?

The company that is not in compliance with the “LGPD” can receive a fine (See Law in full) applied by the National Data Protection Authority (“ANPD”) in Brazil. The fines take effect on August 1, 2021, until then the role of “ANPD” is to guide companies to comply with the new law.

Remember: We are all data owners, we are all citizens. Together we can protect what is ours.
